These Terms of Service ("Terms") govern your use of REALIFIED Play application and services provided by REALIFIED OÜ. By accessing or using our services, you agree to be bound by these Terms.
IMPORTANT: Please read these Terms carefully before using our services. If you do not agree to these Terms, do not use our services.
By downloading, installing, or using REALIFIED Play, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
REALIFIED Play is a PC-to-VR conversion application that transforms PC games into virtual reality experiences for compatible VR headsets, including Meta Quest devices. Our service includes:

You retain all ownership rights to games you convert through our service. By using REALIFIED Play, you represent and warrant that:
You grant us a limited license to process your game data solely for the purpose of providing the VR conversion service to you. We do not claim any ownership over your games or game content.
While we strive to support a wide range of games, we do not guarantee that all games will be compatible with REALIFIED Play. Some games may have technical limitations or anti-cheat systems that prevent conversion.
All intellectual property rights in REALIFIED Play, including but not limited to the software, conversion technology, trademarks, and content, are owned by REALIFIED OÜ or our licensors. These Terms do not grant you any rights to use our trademarks or other proprietary information.
Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding your information, including game usage data and performance metrics.
Some features may require payment. All prices are subject to change with notice. Pricing is displayed in Euros (EUR) as we are an Estonian company, but may be converted to your local currency.

Refunds are provided in accordance with applicable EU consumer protection laws and our refund policy. For EU customers, you have a 14-day right of withdrawal for digital content.

HEALTH WARNING: Virtual reality experiences can cause motion sickness, disorientation, and other physical discomfort in some users. Take regular breaks and stop using the service immediately if you experience any discomfort.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim. This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory.

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. We may also notify you via email or in-app notification. Your continued use of the service after changes constitutes acceptance of the modified Terms.
We may terminate or suspend your access to the service immediately, without prior notice or liability, for any reason, including breach of these Terms, suspected illegal activity, or violation of game publishers' terms. Upon termination:
These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions. As an Estonian company (REALIFIED OÜ), any disputes shall be resolved in the courts of Estonia. For EU consumers, you may also have the right to bring proceedings in your country of residence.
Before filing any formal dispute, you agree to contact us at legal@realified.com to attempt to resolve the issue informally.
For users outside the European Union, any dispute arising from these Terms may be resolved through binding arbitration in accordance with international arbitration rules.
For EU consumers, you have the right to access the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
These Terms and our Privacy Policy constitute the entire agreement between you and REALIFIED OÜ regarding the service.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
These Terms are provided in English. If translated into other languages, the English version shall prevail in case of any conflict.

REALIFIED Play is not endorsed, sponsored, or affiliated with any game publishers or developers whose games may be converted using our service. All game trademarks and copyrights belong to their respective owners. Our service is intended for use with legally obtained games only.
If you participate in any beta or early access programs:
We may release updates, patches, or new versions of REALIFIED Play from time to time. These updates may be automatic or require manual installation. Continued use of the service may require accepting updated versions.
